A lot of you have questions about this years Artist Alley rules and regs. This blog is intended to be a guideline in your decision on whether to apply for the Oni-Con 2010 AA. The rules may change. These rules are not final and Oni-Con reserves the right to deny an AA applicant for any reason it decides without explanation to the applicant.
Tax I.D:
Unless you are giving away your works for free (not fan art) you must have a tax I.D. Tables used exclusively for promotions with no sales do no require a tax I.D. (admittance must be approved by the AA director.)
It has been the decision of the Oni-Con Admin staff that any artists applying for booth space at Oni-Con must show a valid tax I.D regardless of net income. This item is a non-negotiable requirement.
Fan Art:
We have not made a full list of rules, but here is a basic idea:
Problem is that copyright law as it stands is very fuzzy. Info on fan art, fan labor, and fair use is very tough to comprehend. Even the .GOV sites do not give enough info on the subject. So, since you have flooded us with emails asking us about certain loopholes we have decided to give you a stupid long list of what is acceptable.
Fan art includes what you think it does as well as sewing, sculptures, models, and the rest of it.
If you make a majority of your money from fan art you need not apply this year.
You may display fan art as your own expression and interpretation.
Displayed fan art can not make up more than 50% of your displayed works.
Single copies of that 50% may be sold. but not replaced with more fan art. (this may change)
Fan art items may not be displayed in portfolios of art work for sale.
Commissions are between you and the customer.
If any of the Oni Admin/safety staff can determine what character it is at a glance it will be deemed Fan Art.
More than one of the same original (fan art) work will be deemed a violation if it is too similar to another one of your own pieces and will be rejected if it is deemed (by Oni Admin/safety staff) too similar to any piece of licensed material.
If an artist has authorized the reproduction and profit of their art direct us to a document or official website and will review and decide.
